What laws apply to wage payment?

Virginia law recently changed significantly on the subject of wage payments.  An employer who does not pay an employee the wages or salary due on the proper payday faces liability for up to triple the total wages and salaries unpaid or untimely paid, 8% interest, and attorney’s fees.  These situations often arise at the termination of employment as the result of a dispute between the employer and the employee.  Furthermore, deductions from an employee’s paycheck that are not permitted by law can likewise trigger employer liability for unpaid wages.  North Carolina provides for similar though less severe sanctions for unpaid wages.

In either State, an employer should be careful to establish and follow payroll procedures that provide for timely and complete payment of all wages and salaries due.
